My wife is in US since Aug, 2006 on H4.
We missed the H1-B filing last year and it doesn't look good this year too (although her petition got submitted on the first day).
Her last four years job profile (as of now):
- 2.5 years for 'Company A' (one of the top 3 Indian s/w company)
- 10 months for 'Company B'
- 8 months on H4 (in US) - NO work
Can she apply through 'Company A' for an L1 (as she has worked more than a year continuously in the last three years)?
OR its only for an company you are working for currently?
Any help will be greatly appreciated.

Mine reached NSC on July 2 at 9:02 AM. Got Fedex delivery confirmation and no receipt from CIS yet. Will check with my lawyer for advise.

and will only list out the "obvious" possible outcomes which we ourselves can list out.!! So far, at least 2 attorneys I have approaced haven't been able to tell me how 2 485 applications for a single person are handled. Godammit, it is not some rocket science question; it has to be there in some USCIS manual/rule book or a section of the immigration law.

Answer: No. The basis for adjustment is not actual (current) employment but prospective employment. Since there is no requirement that the alien have ever been employed by the petitioner while the I-140 and/or I-485 was pending, the fact that an alien left the I-140 petitioner before the I-485 has been pending 180 days will not necessarily render the alien ineligible to port. However, in all cases an offer of employment must have been bona fide. This means that, as of the time the I-140 was filed and at the time of filing the I-485 if not filed concurrently, the I-140 petitioner must have had the intent to employ the beneficiary, and the alien must have intended to undertake the employment, upon adjustment. You are correct but his case could be that his employer cancelled his 140 which could damage his case more than the use of AC21 to change employers.

Sorry for asking too many questions. One more thing is when did you get this RFE? I am in similar situation---used AC-21 and applied for EAD back in first week of May 2008, but nothing yet from NSC. I was with my GC sponsoring employer for more than 6 months though and I-140 was approved back in 2005.

Interesting (and scary) article about NumbersUSA and related organizations. Although the article is from 2002, and the numbers will have of course have changed, the article claims that the whole anti immigration movement revolves around a group of about 20 very rich people and a few thousand sympathisers, and that member numbers for these organizations are inflated by dividing the total contributions by the annual membership fee and not taking into account large contributions.

Like I said before, W2 should be good enough. If you get employment letter for that period, that will be better.
Typically LCAs are not needed, unless asked to prove H1-B status for job location and other related issues.

Sorry didnt follow up this thread , i dont know why USCIS is asking for colored copies , Passport i dont know but i have seen in clearly through state of ILLINOIS website some where about ITS ILLEGAL TO TAKE ID COLOR COPIES i noticed this when i am taking photo copy color and fedex kinko's person and tore away the color copy and said we both will be at risk as its strictly illegal. I dont know about other states and hence said so , let the RFE come i will then send it for DL; i am sending the one for passport in color though. i enquired with my lawyer he said thats fine just to update you .They might be asking it for clarity in picture i achieved the same using color copier but B/W with light tone effect. It came really good. I hope that useful.

I'm one of those who say with pride that I can create jobs and buy houses. Then why will not congress or policy makers not touch this. As some here said it depends upon what we think about ourselves. If you had been on one of the calls last week that Murthy organized for her clients - you would know what I am saying and why she is doing what she is doing or why she is not doing what everyone else is EXPECTING her to do.

upto March 2005 everything was pre-PERM, post March everything is PERM.
Those stats in the earlier post refer to only PERM LCs (1350 for India).
However I think there are going to be quite a few people with 2004/2005 pre-PERM PDs. In both mine as well as my wife's offices (big silicon valley companies) two things happened between Q4-2004 & Q1-2005 that contributed to many people with that PD:
- lawyers rushed in with filings because PERM was new, not well understood, and any case that they could file earlier, they did.
- the company had a policy of not filing GC after layoffs (2002/2003/2004) and by mid-2004 to end-2004 the economy had recovered enough that the companies felt comfortable starting GC processing again. All of us landed up in queue at the same time.
If you look at the data also you see this 'anomaly' where there is a big 'clump' of cases with PD jan/feb/march 2005.

Is country quota in EB category justified? Hell No. But you know what - if you remove that then entire EB system would be high jacked by Indians, just like they have high jacked H1-B and L-1 visa category.
Agreed.The purpose of H1Bs is to help companies.The purpose of GCs is for political reasons with a Mask named EB.
They don't care if we are tired of working in H1B , many people are in Line to come here on H1.Then they don't have to give you a GC when there are millions of people are ready to work on H1

If you were on OPT you will have Allien# but the EB Catogery gets an allien# after they apply for AOS.
The A# which is present both on the I-140 and the OPT EAD card.
